Trade Press Media Group: June 22 Webcast Will Address Bathroom Access for Transgender Occupants

Milwaukee, Wis. — June 13, 2016 — Bathroom access for transgender individuals has become a hot issue for discussion and litigation. Many transgender individuals — people whose internal sense of their gender is different from the sex they were assigned at birth — are now suing their employer, school, or landlord so that they can use the bathroom that corresponds to their gender identity.

Complicating the issue are recent directives issued by federal agencies such as the Equal Employment Opportunity Commission and the Occupational Safety and Health Administration. The directives make clear that, in order to comply with federal law, employers cannot condition the right to use a bathroom consistent with one's gender identity by requiring transgender individuals to provide proof of surgery or some other medical procedure, or by restricting a transgender individual to a single-occupant private bathroom.

Attorney Joseph Paranac Jr., with LeClairRyan, will present. He focuses his practice on representing clients in employment litigations at the trial and appellate levels in jurisdictions throughout the country. In addition to court-based litigation, he frequently litigates before a variety of administrative agencies including the EEOC, NLRB, OSHA, OFCCP, and DOL. He regularly handles discrimination, sexual harassment, wrongful discharge, whistleblower and employment tort cases.

The learning objectives of this webcast are:

• Review recent litigation and policy updates regarding transgender and gender-specific bathroom and locker room facilities.

• Address the issue of providing transgender students restroom and locker room access consistent with their gender identity.

• Discuss how to deal with occupants and employees who complain about transgender employees using common bathrooms.

• Learn keys to drafting and implementing written policies ensuring that all individuals have prompt access to appropriate sanitary facilities.
